TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of FocusGrain's desktop application and services. By using FocusGrain, you agree to these Terms.

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you and FOCUSGRAIN LTD ("Company", "we", "us", or "our"), a company registered in England and Wales (Company No. [Your Number]), concerning your access to and use of the FocusGrain application and services.

You agree that by accessing FocusGrain, you have read, understood, and agreed to be bound by these Terms. IF YOU DO NOT AGREE WITH THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING FOCUSGRAIN AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. DESCRIPTION OF SERVICE

FocusGrain is a subscription-based desktop application for macOS and Windows that provides visual accessibility features through customisable screen overlays and grain textures. The service is designed to help users with ADHD, dyslexia, and other neurological differences improve focus and reduce eye strain.

3. SUBSCRIPTION AND PAYMENT


3.1 Subscription Plans

FocusGrain offers the following subscription plans:
  • Monthly: £4.00 per month (single user)
  • Annual: £40.00 per year (single user)
  • Team: £475.00 per year (up to 25 users)
  • Enterprise: custom pricing for organisations with more than 25 users. Enterprise licences are priced to be considerably more cost-effective than individual licences at scale. Please contact us at hello@focusgrain.com for a quote.

3.2 Free Trial

We offer a 14-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.

3.3 Payment Processing

All payments are processed securely through our payment provider, Lemon Squeezy. We accept Visa, Mastercard, PayPal, and Apple Pay. Payment information is handled directly by Lemon Squeezy and Stripe — we do not store your payment details.

3.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription fee.

4. CANCELLATION AND REFUNDS


4.1 How to Cancel

You may cancel your subscription at any time by:
  • Logging into your account at app.lemonsqueezy.com/my-orders and clicking "Cancel Subscription"
  • Emailing hello@focusgrain.com with your cancellation request

4.2 Effect of Cancellation

When you cancel, your subscription will remain active until the end of your current billing period. You will retain access to FocusGrain until that date. No refunds are provided for partial billing periods.

4.3 Refund Policy

We do not offer refunds for partial billing periods. The 14-day free trial allows you to evaluate the service before committing to a paid subscription. All sales are final after the trial period ends.

5. USER OBLIGATIONS


You agree to:
  • Provide accurate and complete registration information
  • Use FocusGrain only for lawful purposes
  • Not share your licence key with others outside of your licensed team or organisation
  • Not reverse engineer, decompile, or disassemble the application
  • Not use the service in any way that could damage, disable, or impair our systems

6. INTELLECTUAL PROPERTY


FocusGrain and all associated software, designs, graphics, and content are owned by FOCUSGRAIN LTD and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use FocusGrain for personal or internal organisational use only, subject to the terms of your subscription plan.

7. LIMITATION OF LIABILITY


TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF FOCUSGRAIN IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

WE PROVIDE FOCUSGRAIN "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. DISPUTE RESOLUTION


8.1 Informal Negotiations

If you have any dispute with us, you agree to first contact us at hello@focusgrain.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings.

8.2 Binding Arbitration

If informal negotiations fail, any dispute shall be resolved through binding arbitration in London, England, conducted in English under the rules of the London Court of International Arbitration. The arbitrator's decision is final and binding.

9. GOVERNING LAW


These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

10. CHANGES TO TERMS


We may update these Terms from time to time. We will notify you of any material changes by email and by updating the "Last updated" date at the top of these Terms. Your continued use of FocusGrain after changes become effective constitutes your acceptance of the revised Terms.

11. TERMINATION


We may suspend or terminate your access to FocusGrain immediately, without notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use FocusGrain ceases immediately.
